I take the angle in this case that the intended recipient is the
mailing list (which it is), which by its definition can have arbitrary
subscribers, and so that by proxy *everyone* is an intended recipient.
This probably wouldn't stand up in court, but then neither would that
sort of disclaimer on an email.
